Grand Theft Auto IV publisher Take-Two Interactive is apparently suing Apogee Software due to the failed development of Duke Nukem Forever. In a financial report on Bloomberg.com the details of the case came to light, stating that publishing rights to the 3D Realms title were bought by Take-Two for 12 million dollars in 2000.
"Apogee continually delayed the completion date for the Duke Nukem Forever," Take-Two said in the complaint. "Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever."
This is just another development in a recent spate of Duke Nukem Forever-related news stemming from the announced cancellation of the game.

Stern judges like to award damages. Sometimes.

Bryn says: The man needs payin' back. It's understandable that Take-Two would be pissed off after plowing 12 million into a deal only to have the game yanked. And a game that's been in development for well over a decade would make that an even bitterer pill to swallow.

How successful Take-Two will be in court remains to be seen.
